Short description of the legal framework based on Study 0:
The Dutch Public Procurement Act (Aanbestedingswet 2012) is the Dutch regulation integrating the EU Directive on Public Procurement 2014/24/EU since 2016. The Public Procurement Act is the binding policy instrument that regulates tendering of works and services, including architectural services above the EU threshold value. Both above and below the this value the Proportionality Guide applies to the organization of tendering. Below the threshold value no binding regulations apply. However, Architectuur Lokaal and the BNA (Royal Institute of Dutch Architects) have collaborated on various instruments to enhance and ensure fairness in the competition system. These instruments include the guidelines KOMPAS Light Prijsvragen for managing design contests, KOMPAS Light Architectendiensten for overseeing tendering with design services, and the Guideline for Healthy Architects Selection (Richtlijn Gezonde Architectenselectie).

Definition of Architectural Competition:
The Architectural Design Competition is a competition procedure in which the participants are asked for architectural design services: creating a plan, vision, or design. This usually includes prize money or a design fee; a follow-up order can also be provided on the basis of the submission. It can be seen as a selection procedure to select one or more participants (the winners of the contest) for a negotiated procedure in which a follow-up contract is awarded. This means that procurement law applies to design contest procedures. However, different terms are often applied to different practices; the word tender is often used for competitions (in which developers are involved); competitions are often a collective term for procurement procedures for architect services or works, for design contests or integrated procedures. Many people are not aware that a design competitions can be a procurement procedure too (this definition has been retrieved from KOMPAS Light Prijsvragen).
