Short description of the legal framework based on Study 0:<\/strong>
Decree-Law No. 18\/2008, of 29 January, in its latest version, approves the Public Contracts Code, which establishes the rules applicable to public procurement and the substantive regime for public contracts that are administrative contracts in nature.
The Public Contracts Code transposes Directives 2004\/17\/EC and 2004\/18\/EC, both of the European Parliament and of the Council, of 31 March, as well as Directive 2005\/51\/EC of the Commission, of 7 September, and Directive 2005\/75\/EC of the European Parliament and of the Council of 16 November.<\/p>\n\n\n\n

Definition of Architectural Competition:<\/strong>
DESIGN COMPETITION – The Design Competition is a special pre-contractual procedure, open to the entire competitive market and conducted anonymously, which \u2018… aims to select one or more design works, at the level of a basic programme or similar, namely in the fields of art, spatial planning, urban planning, architecture, engineering or data processing\u2019.<\/p>\n\n\n\n

Professional Qualification Criteria:<\/strong>
To use the professional title of architect in Portugal and to practice the profession, the registration with the Order of Architects of Portugal is required.<\/p>\n\n\n\n

Therefore, after completing the graduation\/ master degree in architecture, registration with the Order of Architects of Portugal is mandatory and includes a professional internship, which includes a 12-month period of professional experience and a training course about Order of Architects of Portugal Statutes and Ethics.<\/p>\n\n\n\n

Academic degree:<\/p>\n\n\n\n

Bachelor’s degree in Architecture approved before March 24, 2006, or an integrated master’s degree in architecture in accordance with a study plan approved after March 24, 2006. Training that proves the acquisition of the knowledge and skills provided for in Directive No. 2005\/36\/EC of the European Parliament and of the Council of September 7, and in the respective transposition legislation, is also considered as qualifying training for registration with the Portuguese Architects Association.<\/p>\n\n\n\n

Qualifying training in the field of architecture:<\/p>\n\n\n\n

a) Holding a bachelor’s degree in architecture or in the field of architecture that satisfies the requirements of paragraphs 1 and 2 of article 43 of Law no. 9\/2009, of March 4, amended by Laws no. 41\/2012, of August 28, and 25\/2014, of May 2, conferred following a cycle of studies carried out within the framework of the organization of studies prior to the regime for the organization of studies introduced by Decree-Law no. 74\/2006, of March 24, amended by Decree-Laws no. 107\/2008, of June 25, 230\/2009, of September 14, and 115\/2013, of August 7;<\/p>\n\n\n\n

b) Holding a master’s degree in architecture or in the field of architecture that meets the requirements of paragraphs 1 and 2 of article 43 of Law no. 9\/2009, of March 4, amended by Laws no. 41\/2012, of August 28, and 25\/2014, of May 2, awarded following an integrated master’s degree study cycle carried out within the framework of the organization of studies introduced by Decree-Law no. 74\/2006, of March 24, amended by Decree-Laws no. 107\/2008, of June 25, 230\/2009, of September 14, and 115\/2013, of August 7;<\/p>\n\n\n\n

c) Holding a foreign higher academic degree in the field of architecture that has been granted equivalence to the degrees referred to in points a) or b) or that have been recognized as being at the same level as these.<\/p>\n\n\n\n

Practical Experience<\/p>\n\n\n\n

The autonomous exercise of acts specific to the profession of architect in Portugal is only accessible to those who have successfully and demonstrably completed the internship consisting of 12 months of professional experience and adequate and sufficient training for registration as an effective member of the Order of Architects, and are effectively such.<\/p>\n\n\n\n

Membership in the Portuguese Association of Architects<\/p>\n\n\n\n

As defined in the Statutes of the Portuguese Association of Architects, approved by Decree-Law No. 176\/98 of July 3, as currently worded, registration with the Portuguese Association of Architects is mandatory for the use of the professional title of architect and for the exercise of the professional acts referred to in Article 44, supplemented by the provisions of Article 46, throughout the national territory.<\/p>\n\n\n\n

Proper and exclusive acts:<\/p>\n\n\n\n

a) Preparation and evaluation of architectural studies, projects, and plans;<\/p>\n\n\n\n

b) Other competences provided for in special legislation that are exclusively reserved for them.<\/p>\n\n\n\n

Activities not exclusive to the architectural profession include studies, projects, plans, and consulting, management, supervision, supervision management, construction management, planning, coordination, and evaluation activities related to construction, urban planning, and the design and development of the spatial framework for the population’s life, aiming at the harmonious integration of human activities in the territory and the enhancement of built heritage and the environment.<\/p>\n\n\n\n

Professional Liability Insurance<\/p>\n\n\n\n

Architects prove their registration and professional competencies by presenting their Professional License.<\/p>\n\n\n\n

Alternatively, if they do not have a Professional License, proof can be provided by presenting a Professional Certificate or the document’s validation\/verification code.<\/p>\n\n\n\n

With active registration with the Portuguese Architects Association and in full exercise of their rights, architects have civil and professional liability insurance.<\/p>\n\n\n\n

Participating in an ADC<\/p>\n\n\n\n

To participate in design competitions in Portugal, architects must confirm their professional qualifications by submitting a declaration attesting to their current registration with the Order of Architects of Portugal. Applicants who practice their profession outside of Portugal may compete on equal terms with applicants qualified to practice their profession in Portugal, provided they hold professional qualifications equivalent to those required in Portugal.<\/p>\n\n\n\n

In Portugal, according to the Public Contracts Code (CCP), the requirement for the competitor’s professional qualification is made before the award of the Prize(s) (in Design Competitions with anonymity) or after the award and before the signature of the contract (in procedures with no anonymity).<\/p>\n\n\n\n

Once the procedure is completed and in order to guarantee the necessary conditions for the signature of the contract, the following documents may be required: proof of current registration with the Order of Architects of Portugal; proof of no debt to the tax authorities and social security authorities; proof of professional liability insurance; proof of other insurance indicated in the rules of the procurement procedure; proof of security deposit; others.<\/p>\n\n\n\n
